This resolution would require Hawthorne Associates to absorb a greater portion of the salary costs for the two officers assigned to this property for enhanced police services at the expiration of the current Memorandum of Understanding, which expires December 31, 2020.

Hawthorne Associates, POAH Communities, and the City of Independence are parties to a Memorandum of Understanding dated May 18, 2010 for the provision of enhanced police services at Hawthorne Place Apartments. The effective terms of the Memorandum extend to December 31, 2020. Under the terms of the Memorandum, the City of Independence assigns two full-time police officers to this site. Hawthorne Associates provides office space for these two police officers at no cost to the City of Independence.
The compensation for these two officers totals $206,685. Hawthorne Associates pays the City of Independence $108,699 or 53% of the compensation costs of these two officers for these enhanced police services. The City of Independence absorbs the remaining $97,986 or 47% of the compensation costs, including $32,656 in salary costs.
Because the off-duty officer rate paid for by a private business for police services is $38.00 per hour Hawthorne Associates would be paying $158,080 for these two officers if the off-duty officer rate were applied as is done for other businesses.
In order to provide a more equitable cost allocation for these enhanced police services, this resolution directs the City Manager to renegotiate the Memorandum of Understanding at the expiration of the current MOU to require Hawthorne Associates to absorb a greater share of the salary costs for these two officers. |

Fiscal Impact:
If the resolution is approved by the City Council, and if Hawthorne Associates were to agree to these new terms, the City of Independence may potentially recognize a savings by allocating a greater portion of these costs to Hawthorne Associates.
Alternatively, if Hawthorne Associates does not agree to these new terms, the City of Independence may potentially recognize additional costs by having to absorb the balance of the compensation currently being paid for by Hawthorne Associates.
Until these negotiations are completed, the true fiscal impact cannot be definitively determined.
