20-058 - 1R.  An ordinance concurrently deannexing certain abutting lands at the southeast corner of Argo Road and 7 Hwy with the City of Blue Springs, Missouri, and authorizing and directing the City Clerk to do those things necessary to accomplish said action.
Recommendations:

Executive Summary:

At the request of the property owners, Mary Jo Falco and Joseph L. Falco, the City of Independence and the City of Blue Springs propose a transfer of land between municipalities, with concurrent detachment by the City of Independence and annexation by the City of Blue Springs. Under Sec. 71.011 RSMo., the property of a municipality which abuts another municipality may be concurrently detached from one municipality and annexed by the other municipality by the enactment by the governing bodies of each municipality of an ordinance describing by metes and bounds the property, declaring the property so described to be concurrently detached and annexed, and stating the reasons for and the purposes to be accomplished by the detachment and annexation.

Background:

The current property owners own approximately 22.67 acres along the east side of 7 Hwy and south of Argo Road.  The portion of the property inside Independence is roughly 240 feet by 1900 feet (or approximately 11.74 acres) and consists of 4 individual parcels.  A single 10.94 acre parcel is located in Blue Springs.

 

This property was annexed into Independence in 1975 as part of the 6.91 square mile annexation generally east of the Little Blue River, south of Truman Road and north of 39th Street.  Since that time the property has remained vacant.  In 1982, the parcels in Independence were rezoned from A-1 to M-1-U.  No development has taken place and the property has been marketed for sale. 

 

The property owners, Mary Jo Falco and Joseph L. Falco, have attempted to develop the property for a number of years.  The property is comprised of multiple parcels of land in both the City of Independence and the City of Blue Springs.  The multiple jurisdictions and corresponding development requirements of each City have made the property difficult to develop.  In order to help foster future development, they have requested that the property be detached from the City of Independence and annexed into the City of Blue Springs.  In doing so, the property would fall solely under the development regulations of the City of Blue Springs, and thus, would be able to follow a more clear and concise development process and would not require the property to be developed under two different sets of Codes and Ordinances.

 

There are no plans for development; the property owners desire to have their property located in one jurisdiction.

 

Under Sec. 71.011 RSMo., the property of a municipality which abuts another municipality may be concurrently detached from one municipality and annexed by the other municipality by the enactment by the governing bodies of each municipality of an ordinance describing by metes and bounds the property, declaring the property so described to be concurrently detached and annexed, and stating the reasons for and the purposes to be accomplished by the detachment and annexation.  Section 71.011 RSMo. does not require a public hearing.  There are no residents on the subject property.  The City of Blue Spring’s City Council will be considering an ordinance to annex this property.

There is no fiscal impact to the City.
