On December 03, 2018, the City Council approved Ordinance No. 18974 which amended Chapter 5 of the City Code for the sale and use of fireworks. The primary change in that ordinance was the legalization of a number of aerial firework devices, ie, bottle rockets. This ordinance would further amend Chapter 5 adding additional restrictions for sale and use. |

This ordinance seeks to address an annual issue regarding citizen calls for service pertaining to the use of fireworks in the City of Independence. Call volume reporting complaints with fireworks use increased substantially this past season. With the removal of bottle rockets, Independence became the only city in the metropolitan area to allow this type of firework. An additional challenge is the extended sales period for fireworks. Presently, City Code allow sales 12-14 days prior to the ordinance allowed time to discharge fireworks. This ordinance seeks to limit the period of time in which fireworks can be discharged as well as restricting the type of fireworks that can be sold and discharged to the pre-2018 City Code restrictions. |

Fiscal Impact:
There is no fiscal impact anticipated as a result of this amendment to Chapter 5. While the ordinance would limit the period of time in which fireworks can be sold and would also limit the type of fireworks authorized for sale, there are no changes in the number of allowed firework tents. Staff does not see an adverse impact on sales tax collections as a result.
