The City Charter Section 3.35 authorizes the procurement manager (agent) to contract for purchases under such regulations and with such exceptions as the Council may provide.
Section 24 of Procurement Policy focuses on Ethics. The current Ethics section details appropriate actions and relationships between the Procurement Division, other internal employees and contractors.
Suggested change to add to the Ethics section is an additional subsection, which would be named subsection L. Subsection L would state “Participates in complying by state and federal law ensuring contractor certifications that counter discriminatory practices”.
Revised Statute §§ 34.600, Anti-Discrimination Against Israel Act”, will become effective on August 28, 2020. This law requires that publicly issued contracts above $100,000, would require contractors to certify they do not engage in discriminatory practices against Israel. This illustrated there is nothing in policy that mandates supporting anti-discriminatory state or federal policy.
