20-080 - 2R.  An ordinance repealing Ordinance No. 18883 passed on May 21, 2018 by the City Council.
Recommendations:

Staff recommends approval. 
Executive Summary:

As provided in Section 3.14 of the City Charter, in May 2018 the City Council approved ordinance 18883 establishing the Department of Public Utilities and designating the Director of Public Utilities. Since that time, organizational structures have evolved and this additional administrative layer is no longer necessary. The City's three utilities--two of which did not exist at the time the City Charter was approved--successfully operate as standalone departments each with its own Director.
Background:

Section 3.14 of the City Charter provides the following:

 

The council by ordinance may provide that the electric utility department shall operate other public utilities, enterprises, and services which the city may operate; and also by ordinance may change the title of the department and of the director to department of public utilities and director of public utilities respectively; provided that nothing herein shall prohibit the council by ordinance from creating a separate department or departments for any one (1) or more such other utilities, enterprises, and services.

 

Ordinance 18883 exercised this authority and established the Department of Public Utilities.  After two years under this operating structure, it has been determined that is creates an unnecessary administrative layer. Repeal of this ordinance would undo the establishment of this department and revert back to operating structure in place prior to approval of the ordinance.
