  1. Council action is requested regarding the application received from Independence Everyday Mart for an Unlimited Retailer of Intoxicating Liquor with Sunday Sales License for the Independence Everyday Mart located at 17121 E. US 40 Highway.  This application requires a two-thirds majority vote for approval due to residential property structures located within three hundred (300) feet of the establishment.
Recommendations:

This application meets the requirements of the City’s Alcoholic Beverage Code.

The applicant is requesting Council approval for the retail sale of intoxicating liquor in the original package seven days a week at the Independence Everyday Mart located at 17121 E. US 40 Highway.

Size of establishment (includes outdoor patio space if applicable): Independence Everyday Mart operates within a 3,200 square foot convenience store located at 17121 E. US 40 Highway. 

Liquor License Types: Unlimited Retailer of Intoxicating Liquor in the original package with Sunday Sales License

Types of Alcohol to be sold/served:  Retail sale of intoxicating liquor of all types in the original package direct to the consumer, but not for resale. 

History of any liquor license at this location; if a new building provides a brief update on the construction: Similar liquor licenses have been issued for this location in the past.  This location will be under new management from any previously issued liquor license.    

Location proximity to residential, park, school and church: There are no hospitals, churches, schools or park property however, there is residentially zoned structures within 300 feet of the proposed premises according to the City’s mapping system.

Managing Officer Information and results from background check:  Shamail R. Mian is appointed Managing Officer for purposes of this liquor license.  The background investigation conducted by the Police Department and the Missouri State Highway Patrol on Mr. Mian revealed he meets the requirements of the Alcoholic Beverages code.

The applicant has submitted a signed affidavit indicating that this location will have alcohol sales that meet the City’s Alcoholic Beverage Code for this license type. Applicable City Departments reviewed the application, and the attached Inspection Report includes their comments.
