  1. Council action is requested for the application received from Cracker Barrel Old Country Store for a Restaurant Bar Malt Liquor and Light Wine with Sunday Sales License for the Cracker Barrel Old Country Store #179 located at 4110 S. Lee’s Summit Road.
Recommendations:

This application meets the requirements of the City’s Alcoholic Beverage Code.

Executive Summary:

The applicant is requesting Council approval for the selling of malt liquor and light wine by the drink at a restaurant bar for consumption on premises seven days a week at the Cracker Barrel Old Country Store #179 located at 4110 S. Lee’s Summit Road.

Size of establishment (includes outdoor patio space if applicable): Cracker Barrel Old Country Store restaurant operates within a 9,715 square foot building. 

Liquor License Types: Restaurant Bar Malt Liquor and Light Wine with Sunday Sales License

Types of Alcohol to be sold/served:  Selling of malt liquor and light wine by the drink at a restaurant bar for consumption on premises.  The retail sale of malt liquor and light wine in the original package is also allowed. 

History of any liquor license at this location; if a new building provides a brief update on the construction:  This Cracker Barrel is an existing restaurant that has never had a liquor license at this location in the past.     

Location proximity to residential, park, school and church: There are no hospitals, churches, schools, park property, or residentially zoned structures within 300 feet of the proposed premises according to the City’s mapping system.

Managing Officer Information and results from background check:  Lorene Epple is appointed Managing Officer for purposes of this liquor license.  The background investigation conducted by the Police Department and the Missouri State Highway Patrol on Ms. Epple revealed she meets the requirements of the Alcoholic Beverages code.

The applicant has submitted a signed affidavit indicating that this location will have alcohol sales that meet the City’s Alcoholic Beverage Code for this license type. Applicable City Departments reviewed the application, and the attached Inspection Report includes their comments.
