| | | | | | | | Executive Summary:
Gardner Capital is currently re-financing the MCP-Independence II, LLC solar project to which City of Independence is a counterparty in the Small Generator Interconnection Agreement (SGIA), the Power Purchase Agreement (PPA) and the Site Lease Agreement for the Hardy Avenue site (former Rockwood Golf Course). Gardner Capital's lender (National Cooperative Bank) requests the City of Independence execute an Estoppel and Consent Agreement for the SGIA and a Consent and Agreement for the PPA and Site Lease.
The original agreements contemplated these types of amendments. The City agreed in the original agreement that these types of requests would be approved during the life of the lease. |
