Agenda Title:

Council action is requested on the change of ownership application from Value Grocers, LLC for the Retail Selling of Intoxicating Liquor of All Kinds in the Original Package for the Save-A-Lot location at 3500 S. Blue Ridge Cutoff.  

Recommendations:

This application meets the requirements of the City’s Alcoholic Beverage Code however the Police Department recommends denial due to numerous liquor code violations at this location (See inspection report for details).

Executive Summary:

The applicant is requesting Council approval for the change of ownership for this Save-A-Lot store to continue selling packaged liquor seven days a week.  This store is currently owned by Moran Foods, LLC.  Value Grocers, LLC is purchasing this store from Moran Foods, LLC.

Size of establishment (includes outdoor patio space if applicable): Save-A-Lot will continue to operate within the same 13,600 square foot grocery store.

History of any liquor license at this location; if a new building provides a brief update on the construction: The current license is held by Moran Foods, LLC and the planned sale of three existing Save-A-Lot locations in Independence to Value Grocers, LLC necessitates this change of ownership request.  As a result of this sale, Save-A-Lot will have a change in legal entity name and changes to the officers of record.  The business operation of the grocery store will remain the same, including the sale of packaged alcoholic beverages.  The applicant has submitted a signed affidavit indicating that this location will have alcohol sales that meet the City’s Alcoholic Beverage Code for this license type.

Location proximity to residential, park, school and church: There are no hospitals, churches, schools or park property however, there is residential properties within 300 feet of the proposed premises.  Change of ownerships do not require public hearings.

Managing Officer Information and results from background check: The proposed business is an LLC whose members have appointed Ms. Stisha L. Burton as Managing Officer for purposes of this liquor license.  Ms. Burton is active in other licenses issued by the Missouri Liquor Control.  The background investigation conducted by the Police Department and the Missouri State Highway Patrol on Ms. Burton revealed she meets the requirements of the Alcoholic Beverages code.

The applicant has submitted a signed affidavit indicating that this location will have alcohol sales that meet the City’s Alcoholic Beverage Code for this license type. Applicable City Departments reviewed the application, and the attached Inspection Report includes their comments.
