Recommendations:

This application meets the requirements of the City’s Alcoholic Beverage Code.

Executive Summary:

Council action is requested on the application received from Kevin Smith for a Restaurant Selling Intoxicating Liquor License for Ain’t Yo Momma Kitchen at 206 N. Main Street.  The applicant has also applied for a Sunday Sales License to be issued administratively upon approval of this license by City Council.

Business Address: 206 N. Main Street

Size of establishment (includes outdoor patio space if applicable): Ain’t Yo Momma Kitchen will operate within the 3,500 square foot restaurant space previously occupied by the Rheinland restaurant. 

Liquor License Types: Restaurant Selling Intoxicating Liquor and Sunday Sales

Types of Alcohol to be sold/served: Various types by the drink in an establishment qualifying as a restaurant.

History of any liquor license at this location; if a new building provides a brief update on the construction: Ain’t Yo Momma Kitchen has opened a restaurant at this location that used to house the Rheinland restaurant.  That establishment held a liquor license for many years.  Ain’t Yo Momma Kitchen will operate as a restaurant selling intoxicating liquor with Sunday sales.  The applicant has submitted a signed affidavit indicating that this location will have alcohol sales that meet the City’s Alcoholic Beverage Code for this license type.

Location proximity to schools, churches, and residentially zoning property: There are no schools or churches  within 300 feet of the premises, however there is residential property according to the City’s mapping system.  For this reason, the City Council must approve this application. 

Managing Officer Information and results from background check: The proposed business is a Sole Proprietorship.  Kevin Smith is the owner of the establishment and will act as the Managing Officer as well.  Mr. Smith is not active in other licenses issued by the Missouri Liquor Control.  The background investigation conducted by the Missouri State Highway Patrol on Mr. Smith revealed he meets the requirements of the Alcoholic Beverages code.

The applicant has submitted a signed affidavit indicating that this location will have alcohol sales that meet the City’s Alcoholic Beverage Code for this license type. Applicable City Departments reviewed the application, and the attached Inspection Report includes their comments.
