Agenda Title:

21-078 - 1R.  An ordinance approving a Development Agreement between D & J Realty Holdings LLC and the City of Independence, Missouri.
Recommendations:

Staff recommends approval of this ordinance.

Executive Summary:

This Ordinance will approve a development agreement between the City and the developer for the new Cargo Largo development located approximately at 3232 S. Noland Road.  A condition of approval of the preliminary development plan required the developer to enter into a development agreement that pertains to the construction of the public streets, traffic facilities, and utilities associated with the project.

Background:

On May 17, 2021, the City Council approved Ordinance No. 19215 approving the Preliminary Development Plan for the Cargo Largo on property at 3232 S. Noland Road.  The preliminary development plan included the construction of an approximate 524,000 square foot on the 30 acres north of the proposed 33rd Street. 

 

As part of the preliminary development plan, the following road improvements were required to accommodate the project: 

 

Noland Road and 33rd Street

o   Install a fully actuated traffic signal that is coordinated with the other signals on the Noland Road corridor and provides railroad pre-emption control. Traffic signal infrastructure will include an east-bound pre-signal

o   Provide a north-bound left turn lane with 200 feet of storage length

o   Provide two outbound lanes in the eastern direction

o   Provide a dedicated right-turn on southbound Noland Road onto 33rd Street.

 

35th Street and Weatherford Road (formerly Lynn Court)

o   Enlarge corner radius in the northeast corner to accommodate truck turning movements

o   Construct a westbound right-turn to extend roughly 250 feet, to tie into the second westbound lane that currently terminates at an existing driveway.

 

Weatherford Road

o   Extend Weatherford Road south to connect with the existing Lynn Court and include any necessary improvements along that portion of existing Lynn Court including but not limited to paving a multiuse trail on west side of street and any easements for power and street lighting.

 

33rd Street

o   Extend 33rd Street west across the railroad tracks to Weatherford Road.

 

Water

o   Construction of water mains extensions throughout the site.

 

Sewer

o   Construction of Sewer mains extensions throughout the site.

 

Landscaping

o   Landscaping and lighting as required by City Code throughout the site.

 

Engineering and Construction Plans

o   Shall comply with all federal, state and City building, zoning, environmental, development or other codes or regulations, subject to modifications approved by the City pursuant to the City Ordinances or as required pursuant to any, zoning environmental, development or other regulations.

 

Fees

o   All applicable construction permit fees, building fees, and utility fees or other like or similar charges will be assessed for the construction of the Final Development Plan and Improvements.

 

These improvements have been incorporated into the development agreement.

 

For construction phasing, the Developer, through the services of their engineer and construction contractor, is required to determine any rights-of-way, easements, or other real property transactions associated with third parties that will be necessary to obtain or enter into in order to complete design, engineer, and construction of the Final Development Plan.  The Developer is required to grant to the City, without compensation, all necessary rights-of-way and easements over property owned by Developer for maintaining the Improvements.

To allow access to the site during construction, both Weatherford Road and 33rd Street shall be constructed with a suitable base material to not damage the surface asphalt and provide Fire Department access for apparatus up to 80,000 lbs. with a minimum width of 20 feet. Repairs of the roadway base shall be the responsibility of the Developer. Acceptance of Weatherford Road and 33rd Street by the City shall occur only after the site nears substantial completion and after the installation of the final roadway surface asphalt.

Per the 2018, International Fire Code as adopted by the City, fire hydrants or some source of water supply for the purpose of fire protection shall be in place prior to the construction of the Final Development Plan and the Improvements.
