Council action is requested on the change of ownership application from 11215 Independence, LLC for the Retail Selling of Intoxicating Liquor of All Kinds in the Original Package license for the Sterling Apple Market located at 11215 E. US 24 Hwy.  

Recommendations:

This application meets the requirements of the City’s Alcoholic Beverage Code.

Executive Summary:

The applicant is requesting City Council approval of a change of ownership for the Sterling Apple Market grocery store to continue selling packaged liquor seven days a week.  The applicant has also applied for a Sunday Sales License and a Tasting Permit and those will be issued administratively should this change of ownership be approved by City Council.

Size of establishment (includes outdoor patio space if applicable): Sterling Apple Market will continue to operate within the same 21,000 square foot grocery store.

Liquor License Types: Retail Selling of Intoxicating Liquor of All Kinds in the Original Package.

Types of Alcohol to be sold/served: Various types in the original package.

History of any liquor license at this location; if a new building provides a brief update on the construction: The current license is held by C & J Management, Inc. and they plan to sell the entire property to 11215 Independence, LLC necessitating this change of ownership request.  As a result of this sale, Sterling Apple Market will have a change in legal entity name and changes to the officers of record.  The business operation of the grocery store will remain the same, including the sale of packaged alcoholic beverages.  The applicant has submitted a signed affidavit indicating that this location will have alcohol sales that meet the City’s Alcoholic Beverage Code for this license type.

Location proximity to residential, parks, schools, and churches: There are no hospitals, churches, schools or park property however, there is residentially zoned properties within 300 feet of the proposed premises according to the City’s mapping system.  Change of ownerships do not require public hearings.

Managing Officer Information and results from background check: The proposed business is an LLC whose members have appointed Sheraz Choudry as Managing Officer for purposes of this liquor license.  The background investigation conducted by the Police Department and the Missouri State Highway Patrol on Mr. Choudry revealed he meets the requirements of the Alcoholic Beverages code. 

 

The applicant has submitted a signed affidavit indicating that this location will have alcohol sales that meet the City’s Alcoholic Beverage Code for this license type. Applicable City Departments reviewed the application, and the attached Inspection Report includes their comments.
