Agenda Title: Council action is requested to authorize the City Manager to approve a construction contract with VF Anderson Builders, LLC for an amount not to exceed $2,283,273.90 authorizing future minor change orders not to exceed $228,327.39 and/or time extensions for the 40 Highway Complete Streets Project. (No. 111802) and waive section six of the City's Purchasing Policy. Postponed from 1/3/22 Council Meeting


Recommendations: Approval of this request is recommended.

Background:

The 40 Highway Complete Streets Project (no. 111802) will provide new sidewalks, dedicated bike lanes, curbs & gutters, push button pedestrian signals, sidewalk ramps, street lighting improvements, retaining walls, and trees on the north side of US 40 Highway.

There were 6 construction bids for this project:

V F Anderson Builders, LLC: $2,285,774.90
Linaweaver Construction, Inc.: $2,485,931.10
Gunter Construction Company: $2,733,210.00
Radmacher Brothers Excavating Co. Inc.: $2,808,564.20
MegaKC Corporation: $2,919,611.00
Leavenworth Excavating & Equipment Co. Inc.: $3,053.585.00
Engineers Estimate: $2,544,406.00

VF Anderson Builders has successfully completed other construction contracts for the city. Their bid is being recommended for approval of this contract.

Per the requirements for federal funding, only an Invitation to Bid process can be used to select a contractor. No Requests for Proposal or Quotation are allowed. Up to $2.5M dollars of federal funding are associated with this project.

Motion to postpone was made during the 1/3/22 Council Meeting.


Fiscal Impact: The fiscal impact to the City is $2,511,601.29. Expense for the 40 Highway Complete Streets Project (No.111802) will be paid from the Streets Sales Tax Fund, account number 7011-5406, and covered through the previously approved fund agreement for this project (ordinance #19124) which allocated $2,500,000.00 from the Federal Surface Transportation Program to the Street Sales Tax funds for the US Highway Complete Streets Project (No.111802/Fed. Project No. STP 3379{437}).
