Agenda Title:

Overview of Resolution 22-723.
Executive Summary:

At the March 7th Regular Meeting of the Independence City Council, City Staff introduced Resolution 22-723. If approved, this Resolution would amend Section 8 of the Procurement Policy by adding additional language regarding lowest and best responsible bidder for all public improvement projects. City Council voted to continue this item to the March 21st meeting and requested a staff presentation at the March 14th Study Session.
Background:

If approved, Resolution 22-723 would add the following language into the City's Procurement Policy:

 

Lowest and best responsible bidder for public improvements means the bidder that meets all the job 
specifications, complies with the following criteria, and submits evidence of such compliance:
1. The bidders and all bidders’ subcontractors for any new development plan, or substantial 
modification to an existing plan, that is approved by the City Council or any economic development 
agency created by the City, state, or federal government and that seeks ad valorem real and personal 
property tax abatement, exemption or redirection, the developer, redeveloper or other entity that 
applies for approval of such plan or modification shall pay or cause to be paid a Prevailing Wage Rate 
to all workmen performing work as a part of the construction, reconstruction, improvement, 
enlargement, alteration, painting and decorating, or major repair of any project for which the total 
project cost exceeds the current minimum level for prevailing wage to be required in Missouri, 
determined and set forth in Sections 290.210 to 290.340 of the Revised Statutes of Missouri. 
2. The Bidders and all bidders’ subcontractors must provide employees with health coverage and a 
retirement benefit.
3. The bidder and all bidders’ subcontractors must have a valid Federal Employer Identification Number 
or, if an individual, a valid Social Security Number, and classify anyone who performs work on public
improvements as employees, not independent contractors.
4. The bidder and all bidders’ subcontractors, to ensure safety on the job site and the safety of 
contractors and employees, must have completed a 10-hour OSHA course.
5. The bidders and all bidders’ sub-contractors must comply with state and federal prevailing wage laws, 
certified payroll requirements, and all rules and regulations related thereto. 
6. The bidders and all bidders’ sub-contractors must participate in active apprenticeship and training 
programs approved and registered with the United States Department of Labor’s Bureau of 
Apprenticeship (or state registered), as applicable for each of the trades under a given contract.
7. The bidder must have a valid certificate of insurance showing the following coverages: general 
liability, professional liability, product liability, workers’ compensation, completed operations, 
hazardous occupation, and automobile.
