Agenda Title:

22-034 - 2R.  An ordinance approving a Development Agreement between Comprehensive Mental Health Services, Inc. and the City of Independence, Missouri.
Recommendations:

Staff recommends approval.
Executive Summary:

Pursuant to the Centerpoint TIF, Centerpoint Medical Hospital (HCA) donated a plot

of land to the City located at 20100 E 39th Street. As outlined in the TIF Agreement, the purpose of the land was for future development of a public safety/para-medical facility.

 

City staff and Comprehensive Mental Health (CMHS) have been working for the past several months on a Development Agreement. As part of the Development Agreement, the City will donate a portion of the plot of land to CMHS to construct a Community Crisis Center. There is growning demand for such services to be offered for the community. 

 

The City would retain ownership for the other portion of the lot and would remain available for future development of a public safety facility.

 

If authorized, staff will proceed executing the terms of the development agreement, including donating a portion of the land to CMHS. 

Background:

As part of the Centerpoint (HCA) TIF, land and funds were allocated to the City of Independence for the specific use to construct a public safety center presence in that area of the city. The funds authorized in the TIF were utilized to develop the Public Safety Dispatch Center within the TIF. This plot of land has continued to be retained for a future public safety facility. 

 

A committee established to identify community mental health and homeless challenges recommended the development of a behavioral health center that would provide critical services to the community and partially relieve service demands on the city’s public safety functions.  Comprehensive Mental Health Services (CMHS) has secured funding for development of the facility and determined this to be an optimal location. The configuration maintains flexibility for the City to develop a public safety facility in the future if deemed necessary. 


Terms of the Agreement include:

 

  • City transfers property to CMHS.
  •  CMHS is required to construct and provide funding for operation of a behavioral health center.
  •  CMHS shall apply for building permits withing 12 months of execution of the agreement and shall be occupied withing 24 months. 
  •  City will be reimbursed for the cost of the land survey previously conducted. 
  •  In the event CMHS fails to comply with the terms of the agreement, including timelines, the property shall be transferred back to the City. 
  •  CMHS will acquire a performance bond equivalent to the value of constructing the project. 
  •  City retains right of first refusal for 10 years in the event CMHS attempts to sell the property.
  •  Deed use restriction requiring property to be used soley for crisis intervention center for benefit of Independence residents. 


Fiscal Impact:

None. the City will be reimbursed for the cost of the survey previously incurred.
