Agenda Title:

Discussion of Resolution 22-771, affirming the City Council’s adherence to certain provisions of the City’s Personnel Policies and Procedures as well as certain Administrative Policies of the City of Independence. 
Recommendations:

Staff recommends several changes to the resolution in order to address questions and concerns raised at recent City Council meetings. A red-lined version of an amended resolution is attached to this item for City Council review and feedback.
Executive Summary:

At the July 18th City Council meeting, the Council discussed Resolution 22-771. The Council voted to postpone the item to the August 1st, 2022 City Council meeting and to further discuss the resolution at the July 25th Study Session.

 

Following City Council discussion on July 18th, staff has prepared an amended resolution for City Council consideration.

Previous Activity:

Resolution 22-771 was first introduced at the July 11th City Council meeting. It was continued to the July 18th City Council meeting and continued again to the August 1st City Council meeting.
Background:

At the June 21st City Council retreat, part of the Council's discussion focused on Council rules and procedures. It was acknowledged that while there are adopted policies and procedures for City staff, there is nothing binding the City Council to these same rules and procedures. This is seen as problematic, given the fact the City Council is exposed to many of the same risks as City staff, including sexual harassments, harassments, workplace violence, cyber security, and use of vehicles for City business, to name but a few. 

 

Following City Council discussion on July 18th, staff developed an amended resolution to address the various questions and concerns that were raised. If approved, the resolution would still bind the City Council to the City's Personnel Policies and Procedures as well as the Adminsitrative Policies. However, the amended resolution suggests the following changes:

 

  • Revising Section 1 to reflect the most current version of the City's Personnel Policies and Procedures Manual.
  • Amending Section 2 to remove AP 98-01 Political Activities from the list of the City's Administrative Policies that would apply to the City Council.
  • Amending Section 3 to reflect the requirement for City Councilmembers to participate in Workplace Violence, Workplace Harassment, and Sexual Harassment trainings in addition to signing and acknowledging the aforementioned policies.
  • Amending Section 5 to reflect that any violations of these policies by a member of the City Council will be investigated by the Chief Human Resources Officer and the final report will be provided to the City Council for review and a recommended course of action. The original resolution placed this responsibility on the City's Personnel Board.
