  1. Council action is requested on the application received from The Marinello LLC for a Retail Selling of Intoxicating Liquor by the drink license at 208 W. Lexington and Retail Selling of Intoxicating Liquor of all kinds in the original package license at 210 W. Lexington Ave.

Recommendations:

This application meets the requirements of the City’s Alcoholic Beverage Code. 

Previous Activity:

The applicant is requesting City Council approval for a Retail Selling of Intoxicating Liquor by the drink license at 208 W. Lexington Monday through Sunday 10:00 am to 10:00 pm and a Retail Selling of Intoxicating Liquor of all kinds in the original package Monday through Sunday 10:00 am – 10:00 pm.  The applicant has also requested a Sunday Sales License and a Tasting Permit.  These licenses will be issued administratively should the City Council approve this license. 

The Marinello LLC plans on operating a whiskey parlor/tasting room at 208 W. Lexington. This location will offer various types of whiskey to purchase by the drink.  They also plan on operating a retail shop at 210 W. Lexington selling whiskey in the original package along with Independence/Kansas City focused merchandise and specialty items.  The Marinello LLC also currently operates a short-term rental at 208 ½ W. Lexington Ave.  The applicant has indicated that this location will have alcohol sales that meet the City’s Alcoholic Beverage Code.

History of any liquor license at this location; if a new building, provide a brief update on the construction:  Prior to The Marinello LLC taking over these locations the building at 208 W. Lexington was most recently operated as a retail space briefly in 2017 before the business closed in 2018.  The space at 210 W. Lexington has had multiple businesses operating out of this location for the past several years with those businesses being hair/nail salons, photography studio, and health care services.

There are active liquor licenses within 1000 feet of these two locations:  Diamond Bowl, Square Pizza, and Big John’s Corner Bar are to the north and Café Verona, Gilbert Whitney, Courthouse Exchange, El Pico, Top Hat Winery, Ophelia’s, 3 Trails Brewing, and Delaware Event Space are to the west.

Location proximity to school, church, or residential zoning: According to the City’s mapping system there are no schools, churches, or residential property within 300 feet of these establishments. 

Managing Officer Information and results from background check: The Marinello LLC has indicated Travis Gensler will serve as the appointed managing officer. The background investigation conducted by the Missouri State Highway Patrol on Travis Gensler revealed he meets the requirements of the Alcoholic Beverages code.
