Agenda Title:

Council action is requested to authorize the City Manager to enter into a Lease Agreement with the Union Pacific Railroad Company for a landscape and beautification easement along the west side of Noland Road, located generally between Osage Street and 35th Street.
Recommendations:

Council approval is recommended.
Background:

The City of Independence entered into a 20-year long-term lease with the Union Pacific Railroad Company in 2003 to landscape and beautify railroad right-of-way along Noland Road between Osage Street and 35th Street. This lease expired on April 1, 2023. The cost of the long-term lease was $15,000. 

Union Pacific is no longer utilizing long-term lease agreements, so the new lease agreement will be an annual lease with automatic renewals each year. The new lease agreement also includes a 3% escalator clause. The fee for the first year’s lease will be $5,000, which is the minimum amount for any Union Pacific Lease Agreement.

Approval of this Lease Agreement will allow for on-going landscaping and mowing on railroad right-of-way along Noland Road between Osage Street and 35th Street, and supports the 2023 City of Independence Action Plan initiative to reduce issues of litter, debris, and illegal dumping, and also enables beautification along a major corridor and entryway into the City.
 


Fiscal Impact:

The fiscal impact to the City is $5,000 for FY23 which will be paid from 6014-5237.  This will be included in the operating budget in future years.
