23-120 2R An ordinance amending Section 5 of the City Code to create a new Article 21 pertaining to feeding operations on park property. (This item addresses item 3.1.k in the 2023-2024 Independence Action Plan).

Executive Summary:

This proposed amendment to Chapter 5 will create a new Article 21 pertaining to Feeding Operations on park property. The amendment requires operators to obtain an operational license, at no fee, from the City specific to feeding operations on park property.  The goal of regulating the feeding operations is not to dissuade the act but to provide accountability for the operators and limit issues of litter and vandalism.

 

The penalty for the first violation is probation with the inability to obtain an operational license for a feeding operation for one year.  There will continue to be no requirement for such an operational license on feeding operations conducted indoors or on private property.

Background:

Parks, Recreation and Tourism staff have been working with the Police Department to increase safety in the parks. Current feeding operations within city parks have led to trash, litter, and unsanitary conditions left behind.  The proposed amendment provides accountability of the operators to ensure park property is left in clean and sanitary conditions, and strengthens police officers' ability to enforce the city code.


Fiscal Impact:

There is no fiscal impact to the City.
